Pass, passport or laissez-passer?
I am not opposed to vaccines in general any more than to that against SARS-CoV-2, quite the contrary having been among the first beneficiaries of this latest vaccine, but am fiercely opposed to any authoritarian interference by a State, of a party, of an individual whatever it is in my way of thinking or acting. As a result I do not have a “health pass” or passport (Pass-port, as Littré spelled it, comes from the supin passum of pandere to deploy, to open and from portus from the Greek πόρος passage – which we find in pore, porous, porosity. Port is also found in Saint-Jean-Pied-de-Port, for example, where one could cross the border).
What is more, when this interference is contrary to the law, as is the establishment of a discriminatory passport drawn up in the name of an alleged health safeguard, despite the approval of a Constitutional Council undoubtedly prey to the ambient and current collective hysteria.
As perfectly explained in the text posted online on Laurent Mucchielli’s blog(1), written by Clément Schouler, magistrate, the law of August 5, 2021 is in formal contradiction with that of July 12, 1990, still in force since not repealed, which stipulates in article 225-1 of the French Penal code that “constitutes discrimination any distinction made between natural persons on the basis in particular of their state of health”, discrimination punishable by three years of imprisonment and a fine of €45,000. , all increased to seven years and €75,000 if the discrimination is committed in a place open to the public.
Several thoughts are in order.
First of all, it is wrong to believe that only people on the right or, worse, on the far right are opposed to the health passport. Only the arguments put forward by these ideologues, such as the reference to the yellow star, are outrageous and questionable (the bearers of the yellow star had no choice, except to live in constant fear or to go underground indefinitely. However the mechanism is identical but reversed: it is the welcome people who display the sesame. Slipping can become dangerous).
Then the question arises whether the vaccine is effective or not. If so, as everything suggests, vaccinated people have nothing to fear from those who refuse the health pass for reasons or from those who cannot obtain it for lack of vaccination and therefore it becomes abnormal and discriminatory to prohibit the latter from rubbing shoulders, on the pretext that they would contaminate them, with other protected humans. Like the lepers of the Middle Ages, will these protesters soon be asked to walk around with a rattle?
Finally, and to close my somewhat long speech, are there more or less risks of possible contamination at the local grocer than in a shopping centre, of any size, restaurants, bars and other places (statistics show that the risks of developing the disease are low given the number of carriers – I would like to remind you that we are all carriers of various and diverse viruses without exception)? No more, no less!
